Claimants who have been found overpaid in unemployment compensation are obligated to repay those funds to the Agency. Decisions regarding the establishment of these overpayments are not made by Unemployment Insurance Recovery and must be appealed to the Appeals Tribunal if disputed. If a claimant fails to make repay the overpayment amount, the Agency may be forced to file a wage garnishment with the court. Before a garnishment is filed, claimants are notified by mail at the address on file with the Agency.
To prevent the Agency from moving forward with the garnishment, claimants are advised to contact their account representative immediately upon receipt of the letter. Our representatives are happy to assist anyone willing to make reasonable efforts to pay the balance due. We encourage claimants to call even if they feel they are unable to make monthly payments as outlined in the standardized pay agreement.
After the garnishment is served on an employer. the overpayment becomes a legal issue that must be handled through the court. The amount withheld from the worker's paycheck is not determined by the Agency. Claimant's wishing to request information about the garnishment amount are encouraged to contact the court in which the garnishment was filed.
