Claimants who have been found overpaid in unemployment compensation are obligated to repay those funds to the Agency. The Agency is federal mandated to submit unpaid balances to the Treasury Offset Program (TOP) for payment. Debt submitted through TOP can be offset by the debtor's federal tax refund or other payments from the federal government.
Before sending a debt to TOP, claimants are sent a letter to their last known address. This letter explains the claimaint's rights and provides 60 days to make payment or enter into a valid pay agreement. Debtors with valid pay agreements are not sent to TOP as long as all payments are received timely.
Payments received through TOP are applied to overpayments which have become final pursuant to State law and will not be refunded. Decisions regarding the establishment of these over payments are not made by Unemployment Insurance Recovery and must be appealed to the Appeals Tribunal if disputed.
